Defendants who have been involved in a criminal matter with the Circuit Court may owe monies to Oakland County.

Defendants may owe monies to Oakland County for:

• Court action that has been delayed
• Completed court action that ordered costs and/or a term of probation

Defendants are responsible for providing information concerning their finances to Reimbursement. A financial interview will be conducted to determine an appropriate payment plan.

The most common fees ordered by the court include court costs, court fines, restitution, state minimum costs, and crime victim rights fees. The fees may be due immediately upon sentencing. Fees not immediately due may be paid over time.

Bond monies will be retained by the County to apply toward costs associated with the case [MCR 6.1061(3)].

Reimbursement collects and disburses restitution due to the crime victim by the defendant. Victim issues are referred to the Probation Office or the Prosecutor's Office Victim Witness Section for assistance.

Supervision fees are ordered when a defendant is placed on probation. Reimbursement does not collect these fees. Payments should be mailed to:

Information provided to this office is confidential and is used in determining monthly payment plans in accordance with the court order. Information needed:

• Social Security Number
• Driver License or State Identification
• All sources of income and/or benefits
• Monthly living expenses
• Installment payments
• Savings/checking account information
• Verification of property ownership/value
• Employer information and pay stubs

A computerized statement detailing the ordered fees and payments will be sent each month as long as the account is current. The top portion of the statement should be returned with payment. The account number must be noted on the check or money order.

Cash, checks, money orders, cashier checks, MasterCard, Visa, American Express and Discover payments are accepted. Online payment options are available on the Reimbursement page. Voluntary income withholding may also be arranged.

Failure to pay court-ordered monies may result in:

• 20% Late Fee after 56 days under MCL 600.4803(1)
• Violation of Probation
• Writ of Garnishment executed against income earnings
• Intercept of state tax refund

Community service hours may be a condition of probation and/or may be worked based on an inability to pay some court-ordered fees. Credit will be given for hours worked which will reduce monies owed. The Probation Department is responsible for overseeing this program.

In accordance with Michigan State law, Oakland County does not charge any court costs, fines, and fees in juvenile delinquency cases except for:

• Crime Victims Fund fees
• Restitution

In accordance with Michigan State law, Oakland County does not collect any of the eliminated court costs, fines, and fees that were charged previously. This includes:

• Court-appointed attorney fees
• Probation oversight fees
• Clinical evaluation or risk assessment fees
• Diversion fees
• Consent calendar fees
• Youth Assistance fees
• Drug testing fees
• Cost of care fees

Oakland County also eliminated bench warrants for juveniles, parents, guardians or other legally responsible persons for failure to appear for show cause hearings on failure to pay Cost of Care fees. In October of 2024, a state law ended the ability of courts across the state to charge and collect most juvenile court costs.

Once a court order has been entered, this office is responsible for collecting those fees.

In accordance with Michigan State law, Oakland County does not charge or collect any court costs, fines, and fees in juvenile delinquency cases except for:

• Crime Victims’ Rights fees
• Restitution

• All sources of income and/or benefits
• Pay stubs
• W-2/1099 forms
• Federal Tax Return and Schedules
• Checking/savings account information
• Verification of assets
• Monthly living expenses
• Installment payments

Information provided to determine financial liability will be treated confidentially and released only to those persons immediately concerned with reimbursement for costs.

Reimbursement collects and disburses restitution due to the crime victim. Victim issues are referred to the Family Court Victims Rights Unit.

Bond monies will be retained by the County to apply toward any balance of costs associated with the case [MCR 5.935].

Any monies ordered by the Court are considered due in full within 30 days unless a satisfactory payment plan is established. If a payment plan is needed, please contact our office.

A computerized statement detailing new charges or payments received in the previous month will be sent on a monthly basis, as long as the account is not in arrears. The top portion of the statement should be returned with the payment. The account number must be noted on the check or money order.

Failure to pay may result in:

• Order to Show Cause action with additional costs being assessed
• Intercept of state tax refund

Oakland County does not collect fines, fees and costs eliminated under state law [See above FAQ regarding the elimination of juvenile delinquency fines, fees and costs]. • Call the Reimbursement Division at 248-858-1130
• Note the address change on the top portion of the monthly statement when the monthly payment is mailed
• Inform Reimbursement staff when making a monthly payment in person.
