Request to Appear Remotely
For all remote appearance requests, please note that your appearance is still required in person unless the Judge approves your request and signs an order. Unless you have a signed order from the Court, you are expected to appear in person on your scheduled court date.
Remote Appearance Request Procedures
Consistent with Michigan Court Rules and Supreme Court Administrative Orders, the 52nd District Court conducts some civil proceedings and very limited criminal proceedings using remote technology. For eligible cases, participants will receive detailed Zoom videoconferencing instructions from the Court or their attorney prior to the hearing.
Requests for remote hearings for cases that have been scheduled in person are discouraged but will be considered for good cause. Additionally, any supporting documentation must be submitted with the request. For example, if you moved out of state, a copy of proof of residency must be included. A remote hearing request received less than SEVEN days before the scheduled proceeding will not be granted unless there is a verifiable emergency.
Civil Infractions
To request remote appearance for a hearing on a civil infraction, please contact the Traffic Department at 248-528-0400, then select option 3 to speak with a clerk.
Criminal Cases
To request a remote appearance for a criminal hearing, the defense attorney or prosecutor must contact the opposing party to request consent to appear remotely and then must complete a Stipulation and Order to Appear Remotely and mail, hand-deliver, or email it to the court at 524criminal@oakgov.com. All parties to the case must be served with a copy of the Stipulation and Order to Appear Remotely or it will not be considered.
If you are the defendant and you are not represented by an attorney, you must contact the Prosecutor directly to request consent and follow the same procedure. Civil Cases
To request remote appearance for a civil case, please contact all parties of record to request consent and complete a Stipulation and Order to Appear Remotely. You will then be required to file the Stipulation and Order through MiFILE, the court’s electronic filing system.
