52-3 District Court Criminal Division

Requests for adjournments are discouraged; however, will be considered for good cause. All adjournment requests should be made as soon as the conflict is known. No adjournments will be granted less than 48 hours before the scheduled hearing date absent verifiable emergency circumstances.

Formal Hearing, Pretrial, Jury Selection, Bench Trial or Sentencing

If you would like to ask for an adjournment of a Formal Hearing, Pretrial, Jury Selection or Bench Trial, you must file a Stipulation and Order for Adjournment pursuant to Michigan Court Rule 2.503. The Stipulation and Order can be personally delivered or mailed to 52/3 District Court, 700 Barclay Circle, Rochester Hills, MI 483073.

Please note that the Stipulation and Order must be filled out completely and signed and dated by both parties to the case. Incomplete forms will be rejected. The stipulation and order should not specifically state a new date unless first confirmed with the court. The new court date will be set by the court and parties will be notified. If the adjournment request is due to a conflicting court date, the judge will follow Michigan Court Rule 2.501(D)(3) in determining whether to grant the request. Please note that no adjournment is granted unless and until the order is signed by the Judge. It is up to the individual requesting the adjournment to follow up with the judge's clerk regarding whether the adjournment has been granted. If the request is made less than 48 hours before your scheduled court date, please contact the Criminal Division at 248-853-5553 to find out the status of your request.

Preliminary Examination

By law, all first requests for adjournment of a Preliminary Examination must be made in person on the court record in order to waive the 14-day rule. If you are asking for a second adjournment of a Preliminary Examination, you must submit a Stipulation and Order for Adjournment and follow the procedures outlined above.

Probation Violation

If you would like to request an adjournment of a Probation Violation Arraignment, please submit an Ex-Parte Motion and Order for Adjournment of Probation Violation Arraignment. The prosecutor's signature is not required on this form.

If you would like to request an adjournment of a Probation Violation Hearing, please submit a Stipulation and Order for Adjournment to the Court following the procedures outlined in the Formal Hearing, Pretrial, Jury Selection, Bench Trial or Sentencing section above. The prosecutor's signature is required on a Stipulation and Order for a contested Probation Violation Hearing.

Once the Ex-Parte Motion or Stipulation has been filed, you must contact your Probation Officer to inform her of your request by calling 248-853-5553 or you may email the Probation Officer at her email address listed on the Probation Department page.

Please note that no adjournment is granted unless and until the order is signed by the Judge. It is your responsibility to follow up with the Court to determine if your adjournment request has been granted.

The most serious category of criminal offenses punishable by more than one year in prison. Initial stages of arraignment and preliminary examination are held in district court. Felony cases are bound over to the Oakland County Circuit Court for trial proceedings.

Offenses punishable by fine or imprisonment not exceeding one year, or both. Operating While Intoxicated, Driving While License Suspended (DWLS), Assault and Battery, Domestic Violence and Possession of Marijuana are examples of misdemeanor offenses processed at the district court.
