Adjournments for criminal cases can only be granted by the Prosecutor. You must contact the prosecutor listed on your notice with a request for an adjournment.

When a defendant is arrested, he or she is brought for an arraignment in front of a Judge or Magistrate to be informed of the charges, and for bond to be set.

A Probable Cause Conference is scheduled between 7 and 14 days after arraignment. At preliminary exam, the judge is responsible for determining if the State has shown probable cause that a crime has been committed and that the defendant committed the crime. If the judge finds probable cause, the case is bound over to the Oakland County Circuit Court for trial proceedings.

Once a case is bound over to the Circuit Court, the District Court record will be non-public. Circuit Court information can be accessed via the Court Explorer or by calling 248-858-0344.

A complaint or ticket is filed with the court. A case number will be given and a judge is randomly assigned. The defendant is either brought in by the police dept or sent a Notice to Appear before the magistrate or judge. At this time, the defendant will be informed of the charges and bond will be set.

The defendant will then be scheduled for a pretrial at a later date. At the pretrial, the defendant will speak to a prosecuting attorney to determine what plea the defendant wishes to enter before the judge. If the defendant pleads guilty the court may proceed with immediate sentence or refer the case for a pre-sentence interview and sentencing at a later date.  If the defendant pleads not guilty, the case will be scheduled for either a bench trial or jury trial, based on the defendant’s choice.

Collaborative Efforts

Oakland County Teen Court Program

Oakland County Teen Court is a successful first offender diversion program for juvenile defendants with minor violations. The program was initiated in 2000 by the Oakland County Prosecutors Office and involves the participation of several District Courts and Oakland County Schools. 52-2 District Court joined the Oakland County Teen Court Program in 2003. Both Judge Fabrizio and Judge Kostin preside in the program. Area students volunteer in the roles of prosecutor, defense attorney, bailiff, and jurors over cases involving their peers, and gain a hands-on approach to the court system. The program is designed with a focus of accountability and positive resolution for juvenile offenders without having a formal juvenile court record.

Mock Trial Program 52-2

District Court participates in the Mock Trial Program sponsored by the Oakland County Bar Association. The program is designed for Oakland County elementary school students with the goal of educating them about the legal system. Mentored by volunteer attorneys, students conduct a simulated trial before a judge.
