52-1 District Court Sentencing Programs & Conditions

Certain offenses require the defendant to only operate a motor vehicle which is equipped with a Camera Ignition Interlock Device. In order to start and successfully operate a motor vehicle the defendant will be required to provide a breathing sample absent of alcohol. At times during operation of the vehicle the device will also require the defendant to provide a breath sample to verify the absence of alcohol.

Another form of alcohol monitoring is the portable alcohol monitoring device. Defendants can be ordered to test on portable alcohol monitoring devices daily to ensure they refrain from the use of alcohol. After sentencing, the defendant obtains the device from a local service center and blows into the device when a test is requested. Test times are prescheduled and the unit can also accept an unscheduled test any time the user desires to take one. The defendant may be required to bring the unit into a service center for data downloads or updates as required by the company or the probation officer.

The Alternative Service Program is court supervised community service at local agencies or municipalities within the court's jurisdiction. As a possible condition of probation, community service may be ordered. Community service hours can be completed at any 501c3 non-profit organization. Examples include schools, nursing homes, libraries, the Salvation Army, places of worship, the Humane Society and Boys and Girls Clubs. This does not apply if the probation order indicates the Alternative Service Program - ASP.

The Court Holiday Enforcement for the Community (CHEC) is an alcohol testing program related to alcohol testing during specific holidays. Defendants sentenced to probation may be ordered to CHEC holiday test to ensure sobriety during common drinking holidays. The CHEC schedule for the current year can be found on the Probation home page.

These three day inpatient weekends may be a recommendation for any substance related charge and may focus on the impact of alcohol or drug use. This program is often recommended on first alcohol related driving offenses with a high blood alcohol level, as a sanction at a probation violation, or for repeat offenders. The goal of the program is to provide a more intense format for presentation of the information concerning drugs and alcohol and an explanation of the available treatment options. A referral can be provided by your probation officer at your next probation appointment.

The Misdemeanor Offender Program, also known as the Retail Fraud Education course, is a three day course held at the 52-1 District Court focusing on education and prevention of retail related theft. Individuals convicted of Retail Fraud, Larceny, or Embezzlement may be ordered to complete this course as a condition of their probation.

To complete this course the defendant must attend the three consecutive sessions held on Tuesdays from 6:00pm to 7:30pm. To sign up for this course, please contact your probation officer.

Pretreatment is a prerequisite to Outpatient Substance Abuse Counseling. This program is often ordered for individuals who have not participated in counseling in the past. This program covers different types of counseling, how to begin counseling, as well as what is required by the court to verify your attendance and completion. This program is held at the court on Tuesday nights from 6:00pm - 7:30pm. Please contact your probation officer to be signed up.

The substance abuse education class provides information regarding alcohol, alcohol products, controlled substances, mind altering substances, and illegal drugs. The intention of the class is to educate first offenders, or youth, of the potential dangers of substance abuse problems. The class is meant for individuals who do not meet the criteria for outpatient counseling, but rather can focus on understanding the effects of alcohol and other drugs on the body. Attendance at support group meetings may be a condition of probation. Support group meetings are defined as any legitimate group meeting comprised of similar people that meet to address experiences or concerns. These groups provide each other with encouragement, comfort, and advice. Examples include AA/NA/MA/HA, Smart Recovery, and CASA to name a few. For more specific instruction and to confirm if a support group meeting qualifies, please contact your probation officer.

Traffic Safety School - Level I and Level II: Each program consists of a one day lecture, which reviews traffic laws, safety issues, defensive driving, and driver responsibility.

The Victim Impact Panel is a two hour panel developed by Mothers Against Drunk Driving (MADD). The panel is composed of individuals who have had family members killed or injured by drunk drivers.

The panel will begin at 7:00pm. Attendees should be there by 6:30pm to check in. Late arrivals will not be admitted.

Drinking or illicit drug use prior to attendance is strictly prohibited. Anyone appearing to be under the influence of alcohol or illegal drugs will not be admitted.

The cost is $50 for in person, and also there is a virtual option with a link to register (cost for virtual is $65).

Attendees must provide a copy of the receipt to their probation officers in order to prove attendance.
